Exemption from the temporary suspension of visa-free privileges JSD-2020-35

Pursuant to Resolution No. 85 dated 26 November 2020 of the Philippine Inter-Agency Task Force for the Management of Emerging Infectious Diseases, the following may be allowed entry privileges to the Philippines under Republic Act No. 6768 or the “Act Instituting the Balikbayan Program”, beginning 07 December 2020:

  1. Filipino citizens’ foreign spouses and children, regardless of age, who are travelling with them; and

  2. Former Filipino citizens, including their foreign spouses and children, regardless of age, who are travelling with them.

The entry of the abovementioned shall be subject to the conditions specified below:

  1. they are allowed visa-free entry under Executive Order No. 408, s.1960;

  2. with pre-booked quarantine facility;

  3. with pre-booked COVID-19 testing at a laboratory operating at the airport; and

  4. subject to the maximum capacity of inbound passengers at the port and date of entry.

The foregoing is without prejudice to immigration laws, rules and regulations. The Immigration Commissioner shall have the exclusive prerogative to decide on waiver or recall of exclusion orders. Furthermore, the entry of the abovementioned foreign nationals shall be subject to the implementing guidelines to be issued by Bureau of Immigration (BI).

Other foreign spouses and children of Filipino nationals who do not belong to the above categories, including those who are not travelling with their Filipino spouse or Filipino parent, are still subject to existing travel restrictions and will need to apply for a temporary visitor’s visa.
